If you’re injured, then you should 100% claim. It was not your fault and now you’re in pain and having to have Physio. It would be the first guy, driver that hit you from behind.

The accident obviously was his fault!

that’s what you have insurance for….it won’t be him directly who’s footing the bill it’ll be his insurance…he might have to pay higher premiums next time, but then that’s what you expect if an accident is your fault

go ahead and claim….you need another car don’t you? and you need compensating for your injuries, your physio, and your pain….not to mention the mental shock of such an accident.

the guy who hit wont be out of pocket, his insurance company will. that’s what they are there for so don’t feel guilty you are entitled to compensation.

you really need to file aa claim it wont come out of his pocket he must have insurance all states require everyone to have it also go back to your the dr.s and see him to see if further damage was done.

Of course you should claim - if he hit you from behind it is his fault. His insurance will pay, so he won’t lose out. Go to the doctor and get yourself checked out in case you’ve done more damage than you realise.
